Mexican Privacy Addendum V1.0

Introductory Text

If you are using the Unmind platform and live in Mexico, then when we collect and use personal information about you, we are subject to Mexican privacy laws. This includes the Ley Federal de Protección de Datos Personales en Posesión de los Particulares.  Our approach to data protection is in line with these laws and is detailed in our Global Privacy Policy.

We ask that you make some time to read the additional information contained in this privacy addendum alongside our Global Privacy Policy so that you understand your rights and choices relating to your personal information as a resident of Mexico.

Our legal basis for processing your information

We describe our purposes, sharing practices and the categories of data we process in our Global Privacy Policy, you can read that here.

When collecting and processing your information for the purposes identified in our Global Privacy Policy, we do so with your explicit consent. This means that when you go to our sign up page, we will require you to read our Global Privacy Policy and this addendum before reading our sign up statement and agreeing to it.

We will keep a copy of your consent with us for the entirety of the time you have an account with us and for three years from the end of your time with Unmind. This is to ensure that we can provide evidence of your consent for any future legal proceedings.

Can I withdraw my consent?

You can withdraw your consent at any time (unless you are withdrawing consent to avoid a legal or contractual obligation). All you have to do is let us know by emailing us at privacy@unmind.com.

Our Support Team will respond to your as soon as possible and make sure that your account is deleted and that we permanently and irrevocably anonymise your information per the data security, integrity and retention section of our Global Privacy Policy.

Your ARCO rights

If you live in Mexico, you have four key rights when it comes to your personal information. These are known as ARCO rights. This means that you have:

  • Rights of Access: You have the right to obtain your personal data from us at any time, as well as information about the processing activities taking place.
  • Rights of Rectification: You can correct your personal details from your account settings, but if you’re having trouble, you can contact us and request that we fix any information we hold about you that is incorrect.
  • Rights of Cancellation: You can request that we delete, suppress or block your information. Be careful, this isn’t a general right to erasure; there are exceptions. But we strive to meet your requests where we can.
  • Rights of Opposition: You can oppose the processing of your personal information or demand that we stop professing your information if you believe we are not doing so the way we said we would in our Global Privacy Policy.

Data Protection Officer

At Unmind, we take the protection of your personal information very seriously, so we have appointed a Data Protection Officer (DPO) to oversee our compliance with Mexican data protection laws. If you have any questions about this addendum or our Privacy Policy, then please contact our DPO at privacy@unmind.com. We will always ensure to respond to you in your preferred language (Spanish or English).
